Uniform Code of Pharmaceuticals Marketing Practices 2024

To regulate interactions between doctors/RMPs and pharmaceutical companies, the Department of Pharmaceuticals issued the Uniform Code of Pharmaceuticals Marketing Practices 2024 on March 12, 2024. This code prevents unethical marketing and ensures responsible promotion of pharmaceutical products. Ethical marketing is essential for maintaining trust and integrity in the healthcare industry.

Key Guidelines:

  • Pharmaceutical companies must ensure the ethical promotion of drugs and remain accountable for their representatives’ actions.
  • Gifts, monetary benefits, and hospitality for doctors and their families are strictly prohibited.
  • Companies must self-declare compliance, disclose expenditures on conferences/workshops, and undergo random or risk-based audits.
  • A two-layer complaint adjudication process allows appeals through the Department of Pharmaceuticals.

Penalties for Violations to Promote Ethical Marketing:

  • Reprimand & public disclosure of violations.
  • Recovery of illicit benefits and notification to the Ethics Committee.
  • Mandatory corrective statements in media for misleading promotions.
  • Legal action under existing laws.

Medical Ethics & Generic Drug Prescription:

The Indian Medical Council (Professional Conduct, Etiquette, and Ethics) Regulations, 2002 mandate ethical relationships between doctors and the pharmaceutical industry. Clause 1.5 requires doctors to prescribe drugs using generic names, preferably in capital letters, ensuring rational drug use.

The National Medical Commission Act, 2019, empowers State Medical Councils and the Ethics & Medical Registration Board to discipline doctors for violations. States must also enforce generic drug prescriptions and conduct regular audits in public health facilities to promote ethical marketing.
