Understanding the Hazardous and Other Wastes Management Rules(HOWM Rules, 2016)
The Ministry of Environment, Forest and Climate Change has implemented the HOWM Rules, 2016 under the Environment (Protection) Act, 1986. Key Features of HOWM Rules, 2016
- Import Regulations: The HOWM Rules, 2016 permit the import of hazardous wastes listed in Part A of Schedule III. Basically, this is for purposes such as recycling, recovery, reuse, and co-processing. However, the disposal of hazardous waste within India is strictly prohibited. Only actual users can import these wastes. Also, they must obtain permission from the MoEF&CC. If applicable, they need a license as well from the Directorate General of Foreign Trade.
- Compliance and Legal Oversight: Any import of hazardous waste without MoEF&CC permission is deemed illegal. Under Schedule VII of the HOWM Rules, 2016, the Ports and Customs Authority is responsible for taking action against non-compliant importers. All in all, this enforces violations under the Indian Ports Act, 1908, and the Customs Act, 1962.
- Annual Reporting: Entities across ten states imported approximately 5.47 lakh metric tons (MT) of hazardous waste. State Pollution Control Boards (SPCBs) and Pollution Control Committees (PCCs) provided this data in the annual inventory. The 10 states are: Andhra Pradesh, Bihar, Gujarat, Jammu & Kashmir, Karnataka, Madhya Pradesh, Punjab, Rajasthan, Tamil Nadu, and West Bengal.
- Roles of SPCBs/PCCs: Under Schedule VII of the HOWM Rules, 2016, SPCBs and PCCs are tasked with granting and renewing authorizations for hazardous waste management. They are also responsible for monitoring compliance with the rules and taking action against any violations.
